PD D87940 March 17, 1999 CLA-2-42:SE:C:D:G02 D87940 CATEGORY: Classification TARIFF NO.: 4202.12.8020 Mr. Ya-el Torbati Delia 435 Hudson Street New York, NY 10014 RE: The tariff classification of a cotton corduroy Bag from Hong Kong Dear Mr. Torbati: In your letter dated February 16, 1999 you requested the tariff classification for a Messenger BagStyle 18097. Style 18097 is rectangular in shape and measures approximately 11 1/2" x 3 1/4" x 12 3/4". All outer surfaces of the bag are of a cotton corduroy fabric with a woven edge trim in a contrasting color. The bag features a single interior compartment lined with a twill fabric. A single pocket with a zippered closure is sewn into the lining. A large flap folds over the top of the bag and attaches to the front by means of two hook and loop fasteners. A single pocket with a flap closure secured by a hook and loop fastener is sewn onto the front of the flap. The bag is carried by means of an adjustable shoulder strap. The applicable subheading for Style 18097 will be 4202.12.8020, Harmonized Tariff Schedule of the United States (HTS), which provides for trunks, suitcases,...and similar containers with outer surface of textile materials, other, attache cases, briefcases,...and similar containers, other, of cotton. The rate of duty will be 18.8 percent ad valorem. Item 4202.12.8020 falls within textile category designation 369. Based upon international textile trade agreements, products of Hong Kong are subject to quota and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
