Milling Kmart Corporation 3100 West Big Beaver Road Troy, Michigan 48084-3163 RE: The tariff classification of two handbags with outer surfaces of man-made fiber fabric from China Dear Ms. Milling: In your letter dated October 7, 1998 you requested a tariff classification ruling. The items which Kmart Corporation intends to import are two handbags: style 8223 having an outer surface made predominantly from a fabric which is composed of 68% polyolefin strips (under 5 millimeters in apparent width) and 32% polyester yarns by weight and style 8224 having an outer surface of a fabric which is composed predominantly of polyolefin strips (under 5 millimeters in apparent width). Style 8223 has a divided interior with a zippered side pocket, a single snap closure at the midpoint of the top opening, two carry handles/shoulder straps, and a small zippered coin purse made from the same fabric as the bag itself which is attached to a strap sewn into the bag’s interior by means of a swivel snap hook. Style 8224 has the same features except that it has a flap closure secured by a single snap, an open top exterior pocket, and the ends of the carry handles/shoulder straps are joined at the top by a wrap around grip. The applicable subheading for the handbags will be 4202.22.8050, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, with outer surface of textile materials, other, other, other, of man-made fibers. The rate of duty will be 19 percent ad valorem. Item 4202.22.8050 falls within textile category designation 670. Based upon international textile trade agreements, products of China are subject to quota and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
