Dear Ms. Gibson: In your letter dated June 26, 1998 you requested a classification ruling. You submitted a sample and referred to it in your letter by two style numbers: Style 108934-20" and 108935-24". We assume these differ only in length. The item is a decorative tubular braid consisting of a double core of textile yarn covered by a braid formed of chenille yarn. It measures approximately 10 mm in width. You state that the braid is made of 60 percent polyester, 30 percent nylon and 10 percent rayon. You state that it will be used as a decoration to a Bath and Body Works gift set. The applicable subheading for the braid will be 5808.10.7000, HTS, which provides for braids in the piece; other; of cotton or man-made fibers. The duty rate will be 8 percent ad valorem. The braid falls within textile category designation 229. Based upon international textile trade agreements products of Taiwan are subject to quota and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
