Dear Ms. Burns: In your letter dated December 11, 1997, on behalf of Tropical Sportswear International, you requested a classification ruling. As requested, the samples will be returned to you. You have submitted three samples, style 201-341-111 is a 100% cotton twill men's woven pair of unlined shorts. The garment features a partially elasticized waistband with a one button closure, a zippered fly front with pleats, belt loops, side slash pockets, two one button back pockets and a hemmed bottom. The garment will be imported in sizes 44-52. Style 107-384-710 is a pair of woven 100% cotton twill woven pants. The garment features a waistband with a one button closure, zippered fly front with pleats, belt loops, front slash pockets, two one button back pockets, one pocket with a flap and cuffed bottoms. The garment will be imported in sizes 31-40. Style 107-384-200 is a pair of woven 100% cotton twill woven pants. The garment features a waistband with a one button closure, zippered fly front, belt loops, front slash pockets, two one button back pockets and finished bottoms. The garment will be imported in sizes 28-30. The applicable subheading for style 201-341-111, will be 6203.42.4050, Harmonized Tariff Schedule of the United States (HTS), which provides for men's or boys' suits, ensembles, suit-type jackets, blazers, trousers, bib and brace overalls, breeches and shorts: trousers, bib and brace overalls, breeches and shorts: of cotton: other: other, shorts: men's. The duty rate will be 17.4 percent ad valorem. The 1998 duty rate will be 17.3 percent ad valorem. The applicable subheading for styles 107-384-710 and 107-384-200, will be 6203.42.4015, Harmonized Tariff Schedule of the United States (HTS), which provides for men's or boys' suits, ensembles, suit-type jackets, blazers, trousers, bib and brace overalls, breeches and shorts: trousers, bib and brace overalls, breeches and shorts: of cotton: other: other, trousers and breeches: men's: other. The duty rate will be 17.4 percent ad valorem. The 1998 duty rate will be 17.3 percent ad valorem. Styles 201-341-111, 107-384-710 and 107-384-200 fall within textile category designation 347. Based upon international textile trade agreements products of the Dominican Republic are subject to quota and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes.
