Dear Ms. Rymal: In your letter dated November 26, 1997, you requested a tariff classification ruling. The sample submitted with your letter was examined and disposed of. Seasoned Color Unit is a greenish-yellow colored powder composed of 56 percent sodium phosphate, 35 percent dextrose, 8 percent caramel powder, and 1 percent oleoresin turmeric. It is for industrial use as an ingredient in the manufacture of potato products such as french fries. The applicable subheading for the food ingredient will be 2106.90.9998, HTS, which provides for food preparations not elsewhere specified or included...other...other...other. The general rate of duty will be 8.2 percent ad valorem. Effective January 1, 1998, the rate of duty will be 7.6 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
