Nicklaus Drive Fountain Hills, Arizona 85268 RE: The tariff classification of crystal lighting fixtures and glassware from the Czech Republic. Dear Ms. Hulpachova: In your letter dated November 5, 1997, you requested a tariff classification ruling. Based on the photos submitted, the crystal lighting fixtures consist of chandeliers and wall lamps. By weight each is made up of 60 percent lead crystal, 25 percent brass and 15 percent plastic. The applicable subheading for the crystal lighting fixtures will be 9405.10.80, Harmonized Tariff Schedule of the United States (HTS), which provides for chandeliers and wall lighting fittings, other than of base metal. The duty rate will be 3.9 percent ad valorem. Articles classifiable under subheading 9405.10.80, HTS, which are products of the Czech Republic will be entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations. Your inquiry does not provide enough information for us to give a classification ruling on the crystal glassware. Your request for a classification ruling should include a sample. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
