Cumins Sharretts, Paley, Carter & Blauvelt 67 Broad Street New York NY 10004 RE: The tariff classification of a woman's jacket from China, Hong Kong, Malaysia, Qatar, and the United Arab Emirates. Dear Ms. Cumins: In your letter dated October 15, 1997, on behalf of your client Foreign Resources Corp., you requested a classification ruling. The submitted sample is style 36602 in plus sizes, and style 96603 in junior sizes. The sample is a reversible pullover jacket with one outer shell of 75% silk, 25% nylon woven fabric, and the other shell of 70% polyester, 30% acrylic knit pile. The jacket features a partial zippered opening, two side pockets and a large kangaroo pocket on the woven side, two slash pockets on the knit side, a drawstring bottom, and a hood with drawstring closure. Your sample will be returned as requested. The applicable subheading for the jacket will be 6202.99.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' anoraks (including ski-jackets), windbreakers and similar articles (including padded sleeveless jackets), of other textile materials, containing 70 percent or more by weight of silk or silk waste. The duty rate will be 2.1%. Style 36602 falls within textile category designation 735. Based upon international textile trade agreements, products of China are subject to quota and the requirements of a visa. Textile category 735 is presently not subject to quota or the requirements of a visa from Hong Kong, Malaysia, Qatar, or the United Arab Emirates. The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
