Box 7152 Akron, OH 44306 RE: The tariff classification of knit polyester fabric from Taiwan. Dear Mr. Schott: In your letter dated October 8, 1997, you requested a classification ruling. The fabric is described as follows: 60" finished width, 100% polyester knit fabric, 150D/96F filament fleece, dyed and heat transfer printed (one side), brushed on both sides; fabric weight approximately 8.8 oz.sq.yd. (298 g/m2); put up rolls on tubes. Its intended use is in the apparel industry. An examination of the fabric revealed it to be of circular knit with sinker loop construction. The applicable subheading for the fabric will be 6002.43.0080, HTS, which provides for other knitted or crocheted fabrics, warp knit, of man-made fibers. The duty rate will be 12.4 percent ad valorem. The fabric falls within textile category designation 222. Based upon international textile trade agreements products of Taiwan are subject to quota and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
