NY C80629 November 25, 1997 CLA-2-63:RR:NC:TA:349 C80629 CATEGORY: Classification TARIFF NO.: 6304.93.0000 Mr. Dennis Heck Yamaha Corporation of America P.O. box 6600 Buena Park, CA 90622-6600 RE: The tariff classification of Electronic Organ Key Covers from Japan Dear Mr. Heck: In your letter dated October 31, 1997 you requested a classification ruling. The submitted sample, referred to as the Yamaha Organ Key Cover part number VP252600, is a dust cover that is designed to fit over the top of your Electone Electronic Organs. The submitted sample measures approximately 17.5 x 42 inches with sides that taper from 5.5 inches at the back to 2.5 inches at the front. There is a 27 inch opening along the top through which the music stand will protrude. This 100 percent nylon taffeta fitted cover is made to protect the keys when the organ is not in use. This cover is similar to the computer keyboard covers that were the subject of Headquarters Ruling Letter (HQ) 960249 dated May 9, 1997. Those covers were ruled to be textile furnishing articles. The applicable subheading for the Organ Key Covers will be 6304.93.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for other furnishing articles, excluding those of heading 9404: not knitted or crocheted of synthetic fibers. The duty rate will be 10.2 percent ad valorem. The Organ Key Covers fall within textile category designation 666. Based upon international textile trade agreements products of Japan are subject to the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
