PD C80231 October 21, 1997 CLA-2-62:CO:CH: DGD IO5 C80231 CATEGORY: Classification TARIFF NO.: 6211.43.0076 Ms. Donna Bever American Shipping Company Inc. 140 Sylvan Avenue Englewood Cliffs, New Jersey 07632 RE: The tariff classification of women's rayon woven vest from China or Hong Kong Dear Ms. Bever: In your letter dated October 1, 1997 you requested a tariff classification ruling on behalf of your client, The Dress Barn, Inc. of Suffern, New York. The submitted sample, Style 1251A, is a vest constructed of 83% rayon, 14% linen, 3% polyester woven fabric. The garment, which extends to the upper thigh area, features a V-neckline, a frontal opening secured by nine buttons, oversized armholes, seven inch side vents and a hemmed bottom. Another garment such as a blouse or shirt will be worn with this item. The applicable subheading for the item will be 6211.43.0076, Harmonized Tariff Schedule of the United States (HTS), which provides for other garments, women's or girls': of man-made fibers: vests: other. The rate of duty will be 16.7%. Style 1251A falls within textile category designation 659. Based upon international textile trade agreements, products of China and Hong Kong are subject to quota and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes.
