Dear Mr. Ree: In your letter dated September 10, 1997, on behalf of Label Lane Int'l Inc., Los Angeles, CA, you requested a classification ruling. The Exporter is Dong Jung Co., Ltd., Seoul, Korea. The submitted sample consists of a 100% polyester circular knit fabric composed of 50D filament yarns. This fabric has been visibly covered on one surface with small flat dots which are silver in color. These dots, which comprise about 1,100 per square inch, are considered to be plastic in nature other than PVC or Polyurethane plastic. The overall effect is that of a silver lam‚ material. You provided the following weight specifications for this material which will be imported as piece goods in 44/45" widths: Weight of fabric: 108g/y2 Weight of foil coating: 2g/y2 Total weight: 110g/y2 The applicable subheading for the fabric will be 5903.90.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for textile fabrics impregnated, coated, covered or laminated, with plastics, ..., of man-made fibers, not over 70 percent by weight of rubber or plastics. The duty rate will be 8.2 percent ad valorem. This merchandise falls within textile category designation 229. Based upon international textile trade agreements products of Korea are subject to quota and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
