JFK Int'l Airport Cargo Building 80, Suite 227 Jamaica, NY 11430-1718 RE: The tariff classification of a chenille yarn, from China. Dear Mr. Pipitone: In your letter dated September 10, 1997, on behalf of American Decorative Fabrics, New York, NY, you requested a classification ruling. The seller is Shartex Int'l, China. The instant sample, identified as style 4.5 N, consists of a chenille yarn, composed of 100% acrylic man-made fibers. It is composed of twisted strands of textile yarn which grip short ends of textile yarns or fibers which produce a caterpillar effect. While the instant sample is composed of 100% acrylic man-made fibers, you wish to know the classification of such yarn composed of 100% cotton or 65% rayon man-made fibers and 35% cotton. The applicable subheading for the yarn in all three cases will be 5606.00.0090, Harmonized Tariff Schedule of the United States (HTS), which provides for ... chenille yarn. The duty rate will be 10.4 percent ad valorem. This merchandise falls within textile category designation 201. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
