Brenman Samuel Shapiro & Company, Inc. 21 South 5th St. Suite 735 Philadelphia, PA 19106 RE: The tariff classification of a birthday sign from China Dear Ms. Brenman: In your letter dated September 4, 1997 you requested a tariff classification ruling on behalf of Unique Industries, Inc. The "Arthur Sidewalk Sign", item #13184, consists of a printed paperboard sign affixed to a 10 inch wooden stake. The paperboard is printed on one side with the phrase "Happy Birthday" across the top and "Arthur" along the bottom. It also portrays a picture of a character surrounded by balloons, cake and presents. The sign measures 9 inches in height by 6 inches in width and is intended to be inserted in the ground outside the home. It is designed as a lawn decoration that also serves to indicate the house in which a birthday, shower or other party is being held. The applicable subheading for the "Arthur Sidewalk Sign" will be 9505.90.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for festive, carnival or other entertainment articles: confetti, paper spirals or streamers, party favors and noisemakers; parts and accessories thereof. The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
