Milton Court Tigard, OR 97224 RE: The tariff classification of headbands from China Dear Ms. Embree: In your letter dated August 28, 1997, you requested a tariff classification ruling. Two samples of headbands were submitted, both designed to tie around the head. One headband is made from a knitted cotton fabric, approximately 38" long, with an embroidered swoosh logo in the center. The other headband is made from a woven cotton fabric, approximately 39" long, with screen printed text. The ends of both headbands are tapered. The applicable subheading for the knitted headband will be 6117.80.8500, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up clothing accessories, knitted or crocheted; knitted or crocheted parts of garments or of clothing accessories: other accessories: other: headbands, ponytail holders and similar articles. The rate of duty will be 15.2 percent ad valorem. The applicable subheading for the woven headband will be 6217.10.8500, HTS, which provides for other made up clothing accessories; parts of garments or of clothing accessories, other than those of heading 6212: accessories: other: headbands, ponytail holders and similar articles. The rate of duty will be 15.2 percent ad valorem. The headbands are not quota from China at this time. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
