Irwin London Fog 1332 Londontown Blvd. Eldersburg, MD 21784 RE: The tariff classification of a polyurethane plastic coated textile fabric for use in the manufacture of garments, from Korea. Dear Ms. Irwin: In your letter dated August 28, 1997, you requested a classification ruling. The instant sample, identified in your letter as style K8232MSM, consists of a woven fabric (P75D x NP120D, 133 x 88) composed of a 82% polyester/18% nylon man-made fiber blend. This fabric has been lightly coated on one side with a "milky" polyurethane plastics material in sufficient quantity to be visible to the naked eye otherwise than by a change of color. You provided the following technical specifications for this material which were not verified by the New York Customs laboratory: Weight of fabric: 116g/m2 (92.8%) Weight of coating: 9g/m2 (7.2%) Total weight: 125g/m2 (100%) The classification of this material is predicated upon its being imported as piece goods as referenced in your correspondence. Any items manufactured abroad from such material and imported into the United States may be classified differently due to the possibility that the manufacturing operation may alter the coating on the material. The applicable subheading for the material will be 5903.20.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for textile fabrics impregnated, coated, covered or laminated with plastics, with polyurethane, of man-made fibers, not over 70 percent by weight of rubber or plastics. The duty rate will be 8.2 percent ad valorem. This merchandise falls within textile category designation 229. Based upon international textile trade agreements products of Korea are subject to quota and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
