Dear Mr. Woehr: In your letter dated August 7,1997, you requested a tariff classification ruling. The samples you have submitted are described as follows: Item 1 is referred to as a "fixing bolt." The upper portion of the fastener has a ball which rests upon a conical shank that ends in a hexagonal base. At the bottom of the base is a threaded shank and on the top of the shank is an non removable washer. The head or ball of the bolt sits inside the vehicle and is used to secure the hydraulic arm(s) to the rear glass (hatch). Item 2 is referred to as a "spacer." It is composed of a steel raised washer fitted with a rubber insert. This item is used in conjunction with item 1. Item 3 is referred to as a "fastener." The item is plastic coated and has a button head and an internally threaded shank with a rubber washer fitted over the shank, and the bottom of the head. Items 1 and 2 are placed against a hole in the rear glass. This leaves only the threads of the "fixing bolt" extending outside the vehicle glass. Item 3 is then placed against the glass and the three pieces are connected. Item 4 is referred to as a "fastener for the hatch glass striker." The fastener has two threaded sections and is rectangular in shape measuring approximately three quarters inch by two and half inches in length. Item 5 is referred to as an "air dam." The item is made of steel and plastic and is used to direct air flow to the rear differential to help cool the differential. The provision applicable to the item 1 "fixing bolt" will be subheading 7318.15.5060, Harmonized Tariff Schedule of the United States (HTS), which provides for Screws, bolts ... and similar articles, of iron or steel: Threaded articles: Studs: Other. The rate of duty is 1.9 percent ad valorem. The provision applicable to the item 2 "spacer" will be subheading 7318.22.0000, HTS, which provides for Screws, bolts ... and similar articles, of iron or steel: Non-threaded articles: Other washers. The rate of duty is free. The provision applicable to the item 3 "fastener" will be subheading 7318.16.0085, HTS, which provides for Screws, bolts ... and similar articles, of iron or steel: Threaded articles: Nuts: Other: Other. The rate of duty is 0.1 percent ad valorem. The provision applicable to the item 4 "fastener for the hatch glass striker" will be subheading 8302.30.3060, HTS, which provides for Other mountings, fittings and similar articles suitable for motor vehicles; and parts thereof: Of iron or steel, of aluminum or of zinc: Other. The rate of duty is 2.4 percent ad valorem. The provision applicable to the item 5 "Air Dam" will be subheading 8708.29.5060, HTS, which provides for Parts and accessories of motor vehicles of headings 8701 to 8705: Other: Other. The rate of duty is 2.7 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
