Robinson International, Inc. 8100 Mitchell Road Eden Prairie, Minnesota 55344 RE: The tariff classification of a looseleaf organizer/planner and a portfolio, from China. Dear Mr. Anderson: In your letter dated June 27, 1997, you requested a tariff classification ruling, on behalf of your client, Portable Products, Moundsview, Minnesota. Samples were submitted, which will be returned to you, as requested. The first article of your request, "Contractors Folio", Stock # 57022, will be the subject of a separate ruling, or decision. The second article is called "Contractors Binder", Stock # 57011. This is a printed paper organizer, titled, "The Critical Path (tm)", "Contractor Planner 1997", bound by a three-ring metal looseleaf binder. It is approximately 1 3/4" by 10 1/2" by 7 1/2" in size, and is covered with woven nylon fabric. It has a three sided zippered exterior closure, and contains several interior pockets and a pencil holder, constructed of woven fabric. The applicable subheading for this product will be 4820.10.2010, Harmonized Tariff Schedule of the United States (HTS), which provides for: Diaries, notebooks and address books bound (of paper or paperboard): Diaries and address books. The rate of duty will be 2.8 percent ad valorem. The third article of your request is called "Folio", Stock # 57021. It is a flat flexible carrying case, made of woven nylon fabric, and is 13 3/4" by 10 1/2" in size. It has a full-length zippered closure, which opens up to a single compartment, and has a detachable wrist strap. The applicable subheading for "Folio", Stock # 57021, will be 4202.12.8030, HTS, which provides for: Other attache cases, briefcases, school satchels, occupational luggage cases and similar containers, other, of man-made fibers. The rate of duty will be 19.3 percent ad valorem. Items classifiable under 4202.12.8030 fall within textile category designation 670. Based upon international textile trade agreements, products of China are subject to visa requirements and quota restraints. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
