Dear Ms. Burns: In your letter dated May 27, 1997, on behalf of Uniforms To You, you requested a classification ruling. As requested, the samples will be returned to you. You have submitted four samples. Style 100013-023 is a man's 65% polyester and 35% cotton striped woven shirt. The garment features short sleeves, a buttoned down collar, a full frontal opening with a seven button closure, a breast pocket and a curved hemmed bottom. Style 2531-00-29 is a man's 65% polyester and 35% cotton striped woven shirt. The garment features short sleeves, a buttoned down collar, a full frontal opening with a seven button closure, a breast pocket and a hemmed bottom. Style 5050-00-10 is a man's 60% cotton and 40% polyester woven shirt. The garment features long sleeves with a two buttoned cuff, a buttoned down collar, a full frontal opening with a seven button closure, a breast pocket and a curved hemmed bottom. Style 5631-00-31 is a man's 55% cotton and 45% polyester woven shirt. The garment features long sleeves with a two buttoned cuff, a collar stay that buttons onto the collar, a full frontal opening with a hidden placket seven button closure, a breast pocket and a curved hemmed bottom. The applicable subheading for styles 100013-023 and 2531-00-29, will be 6205.30.2050, Harmonized Tariff Schedule of the United States (HTS), which provides for men's or boys' shirts: of man-made fibers: other: other, other: with two or more colors in the warp and or filling: men's. The duty rate will be 30.4 cents per kg. plus 27 percent ad valorem. The applicable subheading for styles 5050-00-10 and 5631-00-31, will be 6205.20.2065, Harmonized Tariff Schedule of the United States (HTS), which provides for men's or boys' shirts: of cotton: other, other: other: other: men's. The duty rate will be 20.6 percent ad valorem. Styles 100013-023 and 2531-00-29 fall within textile category designation 640. Styles 5050-00-10 and 5631-00-31 fall within textile designation 340. Based upon international textile trade agreements products of Costa Rica are subject to quota and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
