Box 97000 Redmond, Washington 98073-9700 RE: The tariff classification of men's sweaters from Mauritius, Indonesia, and Thailand. Dear Ms. Rice: In your letter dated April 14, 1997, you requested a tariff classification ruling. Item 054-2994 is a men's sweater constructed from 100 percent cotton, jersey knit fabric which measures 6 stitches per two centimeters counted in the horizontal direction. Item 054-2994 features a rib knit crew neckline; long sleeves with rib knit cuffs; and a rib knit bottom. Item 054-3129 is a men's sweater constructed from 100 percent cotton, jersey knit fabric which measures 6 stitches per two centimeters counted in the horizontal direction. Item 054-3129 features a rib knit Henley neckline with a three button placket; long sleeves with rib knit cuffs; and a rib knit bottom. Item 054-4595 is a men's sweater constructed from 100 percent cotton, cable knit fabric which measures 4 stitches per two centimeters counted in the horizontal direction. The garment features a rib knit crew neckline; long sleeves with a rib knit cuffs; and a rib knit bottom. Item 054-5615 is a men's sweater constructed from 100 percent wool, jersey knit fabric which measures 5 stitches per two centimeters counted in the horizontal direction. Item 054-5615 features a rib knit crew neckline; long sleeves with rib knit cuffs; and a rib knit bottom. As requested, your samples will be returned. The applicable subheading for Items 054-2994, 054-3129 and 054-4595 will be 6110.20.2010, Harmonized Tariff Schedule of the United States (HTS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: sweaters: men's. The duty rate will be 19.4 percent ad valorem. The applicable subheading for Item 054-5615 will be 6110.10.2010, Harmonized Tariff Schedule of the United States (HTS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of wool or fine animal hair: other: sweaters: men's. The duty rate will be 16.7 percent ad valorem. Items 054-2994, 054-3129 and 054-4595 fall within textile category designation 345. Item 054-5615 falls within textile category designation 445. Based upon international textile trade agreements, products of Thailand, Indonesia and Mauritius are subject to a visa requirement and quota restraints. The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.
