Box 269 Sweetgrass, Montana 59484 RE: The tariff classification of boilers from Canada Dear Mr. Sveum: In your letter dated November 26, 1996 on behalf of Saskatoon Boiler Mfg. Co. Ltd., you requested a tariff classification ruling. The OTS ("Off-the-shelf") Series Boilers are developed for small installations requiring up to 1035 lb/hr (470 kg/hr) steam or 1000M BTU/hr (294 KW) hot water. Units are natural or l.p. gas fired or oil fired. Boilers feature a horizontal 3-pass firetube design for greater efficiency and longer life. This ruling request covers only the steam generating OTS boilers. The applicable subheading for the steam generating OTS Series Boilers will be 8402.19.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for Steam or other vapor generating boilers (other than central heating hot water boilers capable also of producing low pressure steam); super-heated water boilers, parts thereof: Steam or other vapor generating boilers: Other vapor generating boilers, including hybrid boilers. The 1996 general rate of duty will be 6.2 percent ad valorem. The 1997 general rate of duty will be 6 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
