Box 3165 Harrisburg, PA 17105 RE: The tariff classification of framed prints from China. Dear Ms. Aldinger: In your letter dated November 22, 1996, you requested a tariff classification ruling. A sample of an item identified as "plastic framed prints" (#970179) was submitted and will be retained for reference. The sample consists of five 8" x 10" sheets of paper, each of which has been lithographically printed with a reproduction of a different painting. This assortment of printed pictures is accompanied by an inexpensive plastic frame incorporating a glass "window" and a hinged back panel with an attached stand. Any of the prints may be displayed in the frame at a given time; they can be easily removed and replaced, suggesting that they are meant to be interchangeable. The applicable subheading for the "plastic framed prints" will be 4911.91.2040, Harmonized Tariff Schedule of the United States (HTS), which provides for printed pictures, designs and photographs...lithographs on paper or paperboard: not over 0.51 mm in thickness...other than posters. The rate of duty is currently 10.6 cents per kilogram. Effective January 1, 1997, the rate of duty will be 9.2 cents per kilogram. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
