Dear Mr. Eisen: In your letter dated November 20, 1996 you requested a tariff classification ruling on behalf of Avon Products Incorporated. The samples will be returned as requested. Style PP 146145, consists of a jacket and pant set. The set is not a track suit. The jacket features a stand up collar, full frontal zippered opening, side pockets, long sleeves with elasticized cuffs and an elasticized waistband. The garment has a woven polyester lining quilted to a non-woven fill. The trousers are silk with a woven polyester lining, an elasticized waistband with a drawstring and side slashed pockets. The applicable subheading for the jacket will be 6201.99.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for anoraks...and similar articles (including padded, sleeveless jackets, of other textile materials, contianing 70 percent or more by weight of silk or silk waste. The rate of duty will be 3.6%. The applicable subheading for the trousers will be 6204.69.4010, Harmonized Tariff Schedule of the United States (HTS), which provides for trousers, bib and brace overalls, breeches and shorts, of other textile materials, of silk or silk waste, containing 70 percent or more by weight of silk or silk waste, trousers, breeches and shorts. The rate of duty will be 6.2%. The jacket falls within textile category designation 734 and the trousers fall within category 748. Based upon international textile trade agreements, products of China, are subject to quota and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
