Dear Ms. Hutchinson: This is a supplement to Ruling No. NY A88238 dated October 10, 1996, which concerned the classification of a 500 milliliter plastic bottle labelled "Standard D'Alcool Ethylique." The product was stated to contain 5 percent ethyl alcohol in distilled water and was used for the calibration and testing of breatherlizers. Subsequent to this ruling, you forwarded a letter dated November 4, 1996 indicating that the subject merchandise contains 0.5 percent ethyl alcohol (margin of plus/minus 1 percent) and not 5 percent ethyl alcohol. All other facts stated in the ruling remain unchanged. A copy of this supplement or the control number indicated above should be included whenever Ruling No. NY A88238 is presented with the entry documents filed at the time this merchandise is imported.
