Dear Ms. Redey: In your letter dated November 11, 1996 you requested a tariff classification ruling. You submitted three samples. Item number 009-1353/1354/1355 is a woman's pullover constructed from 100% cotton, knit fabric. The outer surface of the pullover measures more than 9 stitches per 2 centimeters in the horizontal direction. The garment features a woven pointed collar; a partial front opening with a three button placket; long sleeves with ribbed cuffs; 2 side slits; and a hemmed bottom. Item number 017-2582/2583/2584 is a woman's jumper constructed from 100% linen, woven fabric. The jumper features oversized armholes; a scoop neckline; a partial opening secured by 5 buttons; a drawstring waist; and 2 side seam pockets. Item number 011-1678/1680/1682 is a woman's skort constructed from 100% cotton, woven fabric. The garment is created by a buttoned flap at the waistband, which obscures the leg separation of the shorts beneath it. There are tunnel belt loops and various pockets on the garment. Your samples are being returned as requested. The applicable subheading for the pullover will be 6110.20.2075, Harmonized Tariff Schedule of the United States (HTS), which provides for women's pullovers, knitted: of cotton: other. The duty rate will be 19.9% ad valorem. The duty rate for 1997 will 19.4% ad valorem. The applicable HTS subheading for the jumper will be 6211.49.9060, which provides for tracksuits, ski-suits and swimwear; other garments women's or girls': of other textile materials: other: jumpers. The duty rate will be 7.7% ad valorem. The duty rate for 1997 will be 7.6% ad valorem. The applicable HTS subheading for the skort will be 6204.52.2070, which provides for women's skirts and divided skirts: of cotton: other. The duty rate will be 8.6% ad valorem. The duty rate for 1997 will be the same. The pullover falls within textile category designation 339; the jumper in category 859; and the skort in category 342. Based upon international textile trade agreements products of Malaysia, Hong Kong and Indonesia under the above categories are subject to quota restraints and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
