Dear Mr. DePodesta: In a letter dated October 7, 1996, you requested a tariff classification ruling. Your sample is being returned. Style SMU636 is a man's knit garment constructed from 100 percent cotton, jersey knit fabric which measures 26 stitches per 2 centimeters counted in the horizontal direction. The garment is sleeveless and features oversized armholes; shoulders which measure three and three quarter inches wide; a low, rounded front neckline; embroidered logos on the front and rear panels; large appliques on the front and rear panels; overlaid stripes at each side seam; and a hemmed bottom with side slits. Rib knit edging finishes the neckline and the armholes. The applicable subheading for Style SMU636 will be 6110.20.2065, Harmonized Tariff Schedule of the United States (HTS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: men's or boys'. The duty rate will be 19.9 percent ad valorem. Style SMU636 falls within textile category designation 338. Based upon international textile trade agreements, products of Pakistan are subject to visa requirements and quota restraints. The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected.
