PD A88461 September 21, 1998 CLA-2-62:SF:I10:A88461 CATEGORY: Classification TARIFF NO: 6204.42.3040; 6211.42.0060 Matthew Brauner Brauner International Corp. 1 Exchange Place, Su. 300 Jersey City, NJ 07032 RE: The tariff classification of a women's cotton woven jumper and a girls' cotton woven dress from India Dear Mr. Brauner, In your letter dated October 10, 1996 you requested a tariff classification ruling on behalf of Texloom Group Inc. The garments you submitted, Style #30046 and #17077 will be returned as you have requested. Style #30046 is a women's yarn dyed 100% cotton woven jumper which features a V-neck front, deep cut armhole openings, a buttoned back opening to the fully gathered waist and a long hemmed skirt. Style 17077 is a girls' yarn dyed 100% cotton woven dress styled like the women's jumper, however the armholes are close fitting which allows the dress to be worn alone without another outer garment. The applicable subheading for dress, Style #17077, will be 6204.42.3040, Harmonized Tariff Schedule of the United States (HTS), which provides for Women's or girls' suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): Dresses: Of cotton: Other: With two or more colors in the warp and/or filling: Girls'. The rate of duty will be 11.8%. The applicable subheading for the jumper, Style #30046, will be 6211.42.0060 (HTS), which provides for Track suits, ski-suits and swimwear; other garments: Of cotton: Jumpers. The rate of duty will be 8.5%. The dress falls within textile category designation 336 and the jumper in category 359. Based upon international textile trade agreements, products of India are subject to quota and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. Sincerely, ALICE M.
