Dear Mr. Zelman: This letter replaces the ruling letter dated August 6, 1996, which you recently received. In reviewing that ruling, we have identified a clerical error in the rate of duty contained in the body of the ruling. That clerical error has been corrected in the text below. In your letter dated June 20, 1996, on behalf of Manuli Stretch s.p.a., Italy, you requested a tariff classification ruling. The polyethylene film will be imported on rolls, in varying lengths, widths and thicknesses. Most of the film will be used as packaging material. The applicable subheading for the film will be 3920.10.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for other plates, sheets, film, foil and strip, of plastics, noncellular and not reinforced, laminated, supported or similarly combined with other materials, of polymers of ethylene. The rate of duty will be 4.2 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
