Dear Mr. Alcantar: In your letter dated April 12, 1996, on behalf of your client Maloney and Tabor, requested a tariff classification ruling. The submitted sample is made of a tubular shaped elastic knit fabric with opened ends. It measures approximately 11 inches long by 5 1/2 inches at its widest point. You believe that the article should be classifiable under heading 9506, Harmonized Tariff Schedule of the United States (HTS), which provides for articles and equipment for general physical exercise, gymnastics, athletics, other sports (including table-tennis) or outdoor games, not specified or included elsewhere in this Chapter; swimming pools and wading pools; parts and accessories thereof. The elbow/knee wrap support is not a requisite for sports and outdoor games as enumerated in heading 9506, HTS. This article is not protective in that its primary function is not directly absorbing the impact of blows from collisions or flying objects incident to playing of a sport or game. The applicable subheading for the elbow/knee wrap support will be 6307.90.9989, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles...Other. The rate of duty will be 7 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
