Simpson BARTHCO International Inc. 7575 Holstein Avenue Philadelphia, PA 19153 RE: The tariff classification of FyBron Calcium Alginate Dressing from the United Kingdom Dear Mr. Simpson: In your letter dated March 18, 1996, on behalf of your client, Wound Care Division, B. Braun Medical Inc., you requested a tariff classification ruling. The subject product, FyBron Calcium Alginate Dressing, is a highly absorptive, sterile dressing composed of calcium alginate fibers. It interacts with wound exudate to form a moist gel that maintains an environment for optimal healing, and is designed for the management of exudating wounds, pressure and leg ulcers. According to the product literature, the dressing is available in four sizes, namely: 2" x 2", 4" x 4", 4 x 8", and a 12" rope. The square and rectangular dressings are put up 10 per box, 10 boxes per case (100 dressings), while the 12" rope dressings are put up 5 per box, 10 boxes per case (50 dressings). In a letter dated April 10, 1996, transmitted to this office via fax, you indicated that your client confirmed that these dressings are sent to the end users in their original packings, and are not repacked subsequent to importation. The applicable subheading for the subject product will be 3005.90.5090, Harmonized Tariff Schedule of the United States (HTS), which provides for: "Wadding, gauze, bandages and similar articles (for example, dressings, adhesive plasters, poultices), impregnated or coated with pharmaceutical substances or put up in forms or packings for retail sale for medical, surgical, dental or veterinary purposes: Other: Other: Other." The rate of duty will be free. This merchandise may be subject to the regulations of the Food and Drug Administration.
