NY A81212 April 5, 1996 CLA-2-62:RR:NC:WA 360 A81212 CATEGORY: Classification TARIFF NO.: 6211.42.0081 Ms. Cathy Lasky CSI Industries, Inc. 450 Winks Lane Bensalem, PA 19020 RE: The tariff classification of a woman's woven upper body garment from Hong Kong Dear Ms. Lasky: In your letter dated March 7, 1996, you requested a classification ruling. The sample submitted with your request will be returned to you under separate cover. Style 171-962552 is an upper body garment constructed from 98 percent cotton and 2 percent spandex woven denim fabric. The sleeveless garment features oversized arm openings, a collar, lapels and a full front opening secured by three metal buttons. The garment has two chest pockets with button flaps, two rows of lacing on the back panel and a small pocket below the collar on the back. The garment does not reach the waist. The applicable subheading for style 171-962552 will be 6211.42.0081, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women's or girls': of cotton: other. The duty rate will be 8.5 percent ad valorem. Style 171-962552 falls within textile category designation 359. Based upon international textile trade agreements products of Hong Kong are subject to quota restraints and a visa requirement. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected.
