Deringer, Inc. 173 West Service Road Champlain, NY 12919 RE: Clarification of HQ 959834, dated October 9, 1996 Dear Ms. Cooper: This is in regard to Headquarters Ruling Letter (HQ) 959834 issued to you from this office on October 9, 1996. In HQ 959834 Customs determined the country of origin of certain comforters and a pillow pursuant to Section 102.21, Customs Regulations (19 CFR 102.21). Additionally, the analysis discussed whether the subject merchandise qualified for preferential tariff treatment pursuant to the North American Free Trade Agreement (NAFTA) as per Article 401. Upon further review, Customs has determined that the holding stated in HQ 959834 should be clarified. Although the holding correctly stated that the comforters and pillow were eligible for the NAFTA preference, it did not clearly indicate the rate of duty for that merchandise. As such, this is to inform you that the applicable rate of duty for the comforters is 1 percent ad valorem, and 1.2 percent ad valorem for the pillow.
