Box 89 (78042) Laredo, Texas 78040 RE: The tariff classification of a plastic tool box from Mexico. Dear Mr. Zuniga: In your letter dated February 5, 1994, on behalf of Rubbermaid Incorporated, you requested a tariff classification ruling. The tool box is composed of molded plastics. The sample you submitted does not contain a tray and is not specially shaped or fitted to contain particular tools. The label on the sample tool box, however, indicates that the tool box does come with a tray. This ruling applies only to tool boxes that are not specially shaped or fitted to contain particular tools or accessories. The applicable subheading for the plastic tool box, when it is not specially shaped or fitted to contain particular tools or accessories, will be 3926.90.9590, Harmonized Tariff Schedule of the United States (HTS), which provides for other articles of plastics, other. The rate of duty will be 5.3 percent ad valorem. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported.
