Klestadt Trans-World Shipping Corp. 53 Park Place New York, New York 10007 RE: The tariff classification of a limestone tile from Italy. Dear Mr. Klestadt: This is in response to your request dated October 22, 1992, on behalf of your client Innovative Marble & Tile, Inc., for a tariff classification ruling. The merchandise was sent to the Customs Laboratory for analysis. The sample which you have submitted (Botticino Classico) is a polished stone tile, which is beige in color with white specks. The item measures 10 cm by 7.6 cm. It has a thickness of 1 cm and has a bevel of approximately 2 mm. You state that the product is a marble tile. However, analysis of this merchandise by our Customs laboratory indicates that it is actually geological limestone (other calcareous stone), not marble. The provision applicable to the Botticino Classico will be subheading 6802.92.00, HTS, which provides for worked monumental or building stone (except for slate) and articles thereof other than goods of heading 6801: Other: Other calcareous stone. The rate of duty will be 6 percent ad valorem. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction. Sincerely, Jean F.
