Dear Mr. Spatarella: This classification decision under the Harmonized Tariff Schedule of the United States (HTS) is being issued in accordance with the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). DATE OF INQUIRY : May 14, 1990 ON BEHALF OF : Kanematsu USA Inc. DESCRIPTION OF MERCHANDISE : Sample and literature indicate that the article to be imported is a single phase 100 watt A.C. electric motor. HTS PROVISION : Other A.C. motors, single phase, of an output exceeding 74.6 W but not exceeding 746 W. HTS SUBHEADING : 8501.40.4040 RATE OF DUTY : 5 percent ad valorem. OTHER : The sample(s) will be returned as requested. We suggest that you consult the Customs office at the port where you will enter the merchandise concerning an origin of marking waiver. A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported.
