Lynch Sullivan & Lynch 156 State Street Boston, Massachusetts 02109-2508 RE: The tariff classification of a woman's sweater from Hong Kong. Dear Mr. Lynch: In your letter dated November 22, 1995, on behalf of Susan Bristol, Inc., you requested a tariff classification ruling. The submitted sample, style number 13283, is a woman's sweater constructed from a patchwork mixture of novelty woven and knit pointelle fabrics. The garment is composed of 55% ramie, 45% cotton, knit fabric (sections of front panels and entire back), and 95% polyester, 5% rayon, woven fabric (sections of front panels). The sweater features a V-neckline; short sleeves; and a full front opening with a 4 button closure. Your sample is being returned as requested. In your letter and a telephone conversation you stated the following: WOVEN WEIGHT PER OZ. AREA (95% poly., 5% rayon) Floral Dot .92 12% Dot Print 1.44 19% Floral Jacquard .70 9% Subtotal 3.06 40% KNIT (55% cotton, 45% ramie) Ramie 2.06 60% cotton 1.69 Subtotal 3.75 60% The essential character of the sweater is imparted by the knit fabric, Harmonized Tariff Schedule of the United States(HTS), General Rules of Interpretation(GRI),3(b), noted. The applicable subheading for the sweater will be 6110.90.9042, Harmonized Tariff Schedule of the United States (HTS), which provides for women's sweaters, knitted: of other textile fibers: other. The duty rate will be 6% ad valorem. The duty rate will be the same for 1996. The sweater falls within textile category designation 845. Based upon international textile trade agreements products of Hong Kong are subject to quota restraints and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes.
