Dear Ms. Heimerle: In your letter, which was dated July 06, 1995, you requested a tariff classification ruling. Style number S53028 is a man's sweater constructed from 39 percent silk, 32 percent cotton, 26 percent linen and 3 percent hemp intarsia knit fabric containing 3 stitches per 2 centimeters counted in the horizontal direction. The garment has a rib knit, crew neckline; long sleeves with rib knit cuffs; and a rib knit waistband. Your sample is being returned as you requested. The applicable subheading for Style S53028 will be 6110.90.9020, Harmonized Tariff Schedule of the United States (HTS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of other textile materials: other: sweaters for men or boys': other: other: of silk: other. The duty rate will be 6 percent ad valorem. Style S53028 falls within textile category designation 846. Based upon international textile trade agreements, products of the People's Republic of China are subject to visa requirements and quota restraints.
