Barth Co., Inc. 7575 Holstein Avenue Philadelphia, PA 19153 RE: The tariff classification of a needleloom felt containing a base material, from Germany. Dear Mr. Slagle: In your letter dated July 1, 1994, on behalf of Synteen USA, Inc., Hainesport, NJ, you requested a tariff classification ruling. The instant sample, described as Bitutex with PP-PGM Fleece 131.140, is constructed from a textile web of polyester fibers that have been needled through a base scrim. The scrim, a special type of weave of polyester yarns with a 30 x 30 open mesh, is coated with modified SBR (styrene butadiene rubber). The material, which measures about 3mm in overall thickness and weighs approximately 407g/m2 is to be used for road and runway asphalt reinforcement. It will be manufactured in lengths of 100 meters and widths of either 220 or 330 centimeters. The applicable subheading for the product will be 5602.10.9090, Harmonized Tariff Schedule of the United States (HTS), which provides for needleloom felt and stitch-bonded fiber fabrics, of other than wool or fine animal hair. The rate of duty will be 12.5 percent ad valorem. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported.
