Box 204 Honesdale, PA 18431 RE: Clarification of HQ 083458 of August 31, 1989 Dear Miss Colton: On August 31, 1989, we sent you a binding ruling concerning classification of Asana Yoga suits under the Harmonized Tariff Schedule of the United States Annotated (HTSUSA). This letter does not alter that classification, but merely clarifies certain portions therein. In conversations with this office, you stated that the shirts and pants are primarily imported and marketed together; one top and one bottom in one polyurethane bag. It is this statement which we relied upon in drafting the first paragraph of the HOLDING in HQ 083458. It has been brought to our attention that the statement made in the HOLDING paragraph of our ruling indicated that, when imported separately, those garments in excess of the matching numbers of pants and shirts do not qualify for tariff treatment as ensembles. It should be understood that the term "ensembles" applies only to garments imported together as sets put up for retail sale. Therefore, those "excess" garments would not qualify for tariff treatment as ensembles, or parts thereof. Sincerely, John Durant, Director Commercial Rulings Division
