Totowa, New Jersey 07512 RE: The tariff classification of a girl’s leotard from China. Dear Ms. Stanczak: In your letter dated February 25, 2008, you requested a classification ruling. You state that the submitted sample is a camisole; however examination reveals that the item is a leotard. Style 4006C is a girl’s leotard made of knit fabric that is 90% nylon, 10% spandex. The sleeveless garment has two textile shoulder straps and a drop vee opening at the front neckline. The article is cut straight across the back below the armhole openings. The applicable subheading for Style 4006C will be 6114.30.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Other garments, knitted or crocheted: Of man-made fibers: Bodysuits and bodyshirts, Of fabric containing by weight 5 percent or more of elastomeric yarn or rubber thread." The rate of duty will be 32% ad valorem. Duty rates are provided for your convenience and are subject to change.
