Dear Ms. Marlowe: In your letter dated May 21, 2007, on behalf of your client Sweater.com Apparel, Inc., you requested a tariff classification ruling. The submitted sample, Style #24604, is woman’s shirt constructed from 65% rayon, and 35% nylon rib knit fabric. The garment features long sleeves, a shirt-style collar, a partial front opening with an eight button closure, and a self-finished bottom. The knit to shape provisions of Chapter 61, Statistical Note 6 do not apply to garments classified as shirts. We are returning your sample as you requested. The applicable subheading for the shirt, Style 24604, will be 6106.20.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ blouses and shirts, knitted or crocheted, of man-made fibers, other, women’s. The rate of duty will be 32% ad valorem. Duty rates are provided for your convenience and are subject to change.
