NY M82660 April 28, 2006 CLA-2-39:RR:NC:TA:350 M82660 Ms. Lucy Norlie Creative Design Ltd. 312 Old Grande Blvd., Suite C-124 Tyler Texas 75703 Dear Ms. Norlie: We are returning your request for a ruling dated April 18, 2006, and the related sample, because your letter is ambiguous and additional information is required. Your letter made mention of three materials, which were identified as styles MSI – VP601, MSI – VP603, and MSI – VP605. However, you only supplied a representative sample of style MSI – VP603. In that regard, you supplied a breakdown by fiber/plastic content in your letter, which differed from the figures supplied in an included “Test Result Sheet”. Because of various nuances in the tariff laws, this can make an important difference in the tariff status of the products as well as affecting the potential quota status of the merchandise. We request that you supply a representative sample of each style you wish to import, along with a verifiable breakdown, by weight, of each of the respective components incorporated therein. If you decide to resubmit your request, please include all of the material that we have returned to you and mail your request to U.S. Customs and Border Protection, Customs Information Exchange, 10th Floor, One Penn Plaza, New York, NY 10119, attn: Binding Rulings Section. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Deborah Walsh at 646-733-3044. Sincerely, Robert B. Swierupski Director, National Commodity Specialist Division
