Dear Ms. Kwok: In your letter dated March 24, 2006, you requested a tariff classification ruling. The sample provided with your letter is a small acrylic perfume bottle with a metal chain and split ring. The bottom of the bottle is molded in the shape of a rose. There is a threaded metal cap with an attached acrylic dauber to apply the perfume. The cap is attached to a small length of chain and a split ring. The ring may be used either as a key ring or to attach the bottle to a purse or belt. You state that the perfume bottle holder will be sold as a promotional item and suggest classification in heading 3923, which provides for articles for the conveyance or packing of goods. The containers of heading 3923 are those for the conveyance or packing of commercial goods, and not containers meant to hold or convey personal goods. These perfume bottles will not be used to package perfume for sale. Rather, the perfume bottles will be filled and refilled by the buyer and are for personal use. The applicable subheading for the perfume bottle holders will be 3926.90.9880, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other articles of plastics, other. The rate of duty will be 5.3 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
