Dear Mr. Fragomeli: In your letter dated January 5, 2006, you requested a tariff classification ruling. You submitted the following costume, which meets the flimsy, non-durable requirements and is being returned per your request: Item numbers 6808788, 6807817 and 6807818, Archie, are three sizes of a textile costume set that consists of a polyester shirt and a pair of polyester pants, with the shirt imparting the essential character. Although the shirt has a well-made styling feature, it has flimsy construction of the neck and seams and flimsy edges at the arms, hem and collar. The applicable subheading for item numbers 6808788, 6807817 and 6807818, Archie, will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other." The rate of duty will be Free.
