One Park Avenue New York, NY 10016 RE: The tariff classification of a plastic “beaded” door curtain from China. Dear Ms. Abustan: In your letter dated February 18, 2004, you requested a tariff classification ruling. The sample provided with your letter is a plastic “beaded” door curtain. The curtain can be hung by a plastic rod with metal hooks. The curtain is made not by stringing pre-existing beads but by molding plastic shapes onto a string. As you requested, the sample will be returned. You asked about quota and GSP. This merchandise is not subject to quota or visa requirements. Goods produced in China are not eligible for GSP treatment. The applicable subheading for the plastic beaded door curtain will be 3924.90.1010, Harmonized Tariff Schedule of the United States (HTS), which provides for tableware, kitchenware, other household articles and toilet articles of plastics: other: curtains and drapes, including panels and valances; napkins, table covers, mats, scarves, runners, doilies, centerpieces, antimacassars and furniture slipcovers; and like furnishings…curtains and drapes. The rate of duty will be 3.3 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
