NY K83417 March 11, 2004 CLA-2-61:RR:NC:TA:359 K83417 CATEGORY: Classification TARIFF NO.: 6110.20.2075 Mr. Nicholas Treppiedi Mersant International Ltd. 158-12 Rockaway Blvd. Jamaica, NY 11434 RE: The tariff classification of three women’s knit garments from Hong Kong Dear Mr. Treppiedi: In your letter that was received in this office on February 13, 2004, on behalf of Danskin, Inc., you requested a tariff classification ruling. You submitted three samples of women’s garments that are made from 100% cotton, knit fabric. The outer surface of the garments measures more than 9 stitches per 2 centimeters in the horizontal direction. Style 4639 is a cardigan that features a hood, long sleeves, a full front opening with a zipper closure, and kangaroo style pockets in the front at the bottom. The sleeves and the bottom of the garment are unfinished. The hood and the pockets are finished with woven capping. Style number 4649 is a cardigan that features a ribbed collar, long sleeves with ribbed cuffs, a full front opening with a zipper closure, and a ribbed bottom that extends from part of the front panels to the back panel. The remainder of the bottom front panels is made from the same fabric as the body. Vertical strips of ribbed fabric extending from the shoulders to the sleeve cuffs are inserted in the sleeves. Style number 4664 is a pullover that features a V-neckline, long hemmed sleeves, 2 side slits, and a hemmed bottom. A floral design is on the front panel. Your samples are being returned as requested. The applicable subheading for each of the three garments will be 6110.20.2075, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers…and similar articles, knitted: of cotton: other…other: women’s. The rate of duty will be 16.5% ad valorem. Each of the three garments falls within textile category designation 339. Based upon international textile trade agreements products of Hong Kong are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.cbp.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
